1. Agreement to Terms

These Terms of Service govern your use of NYLE, a cybersecurity assessment platform provided by NYLE Technologies, a company governed by the State of Maryland.

By creating a NYLE account, you agree to these Terms and our Privacy Policy. While using NYLE on behalf of a company or organization, you represent that the entity agrees to these Terms.

2. Service Description

NYLE is a Governance, Risk Management, and Compliance (GRC) platform for cybersecurity self-assessments against FedRAMP standards.

The NYLE Console includes:

• Guided security questionnaires for gap analysis projects

• Visualization dashboard

• Downloadable PDF reports

• Community thread for discussion

3. Eligibility

NYLE is for commercial and business use only. You must be at least 18 years old and authorized to enter contracts on behalf of a business. NYLE is not available for individual personal use.

4. Account Registration

To create an account, sign up at nyle.app with your name, email, company name, company size, and title/role.

You're responsible for:

• Maintaining confidentiality of your account credentials

• All activities under your account

• Notifying us immediately of any unauthorized access

5. Pricing and Payment

• You pay per gap analysis project when you initiate it

• Payment is processed through Stripe (PCI Level 1 compliant)

• All purchases are one-time fees and non-refundable

We may change pricing with advance notice. Price changes won't affect projects you've already purchased.

6. Data Ownership

You retain full ownership of:

• All data you input into NYLE

• Any free response data shared in your questionnaire responses

• Content you post in the community thread

We only use your data to provide the NYLE service. For details on how we collect, use, and protect your data, see our Privacy Policy.

You can download your data anytime from the console.

7. Acceptable Use

You must use NYLE legally and responsibly.

Prohibited Activities

You may not:

• Use NYLE for illegal purposes or violate any laws

• Hack, breach security measures, or access others' data or accounts

• Introduce malware, viruses, or malicious code

• Share your login credentials with unauthorized users

• Reverse engineer the platform

• Harass, threaten, bully, or impersonate others

• Post hateful, discriminatory, or violent content

• Send spam or unsolicited messages

• Post repetitive or off-topic content

• Use NYLE to promote competing products

• Create multiple accounts to evade restrictions

• Post false, misleading, or copyrighted material without authorization

• Post confidential information without permission

• Disrupt service or other users' access

• Overload systems with excessive requests

• Scrape or extract data using automated tools

Community Thread Guidelines

Do:

• Be respectful and professional

• Share helpful insights

• Stay on topic

• Report violations to us

Don't:

• Post sensitive, confidential, or personal information publicly

• Engage in arguments or personal attacks

• Post promotional content

• Share misinformation

Enforcement

If you violate this policy, we may:

• Issue a warning

• Remove content

• Suspend your account

• Terminate your account

• Report illegal activity to authorities

Security Vulnerability Reporting

If you discover a security vulnerability:

• Report it to us immediately

• Don't exploit or share the vulnerability

• Don't access data that doesn't belong to you

8. Intellectual Property

NYLE's platform, technology, and content are our property. This includes the NYLE software, console, assessment methodology, reports, and all trademarks.

By using NYLE, you grant us a limited license to use your data solely to provide the service, generate your reports, and display your community posts to other users.

9. Service Availability and Disclaimers

NYLE is provided "as is" and "as available." We don't guarantee:

• Uninterrupted or error-free service

• That NYLE will meet all your specific requirements

• 24/7 availability without maintenance windows

• That third-party services (Stripe, Bubble.io, AWS) will always function perfectly

We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Important: Using NYLE doesn't guarantee compliance with FedRAMP or any other standard.

10. Limitation of Liability

To the maximum extent permitted by law:

Our total liability to you is limited to the amount you paid us in association with the specific claim being referenced.

We're not liable for:

• Indirect, incidental, special, or consequential damages

• Lost profits, data, or business opportunities

• Service interruptions or delays

• Third-party actions or content

Exceptions:

• Our gross negligence or willful misconduct

• Matters that cannot be limited by law

11. Term and Termination

This agreement continues until terminated by either party.

You may terminate by contacting us to close your account.

We may terminate if:

• You violate these Terms

• You fail to pay for services

• We cease offering NYLE

• Required by law

Upon termination:

• You have 24 hours to download your data

• After 24 hours, we'll begin deleting your data per our retention schedule

Data deletion: If you accidentally post sensitive information, you can delete it from the console or contact us for backend deletion assistance.

12. Changes to Terms

We may update these Terms and will notify you via email, our website, or the NYLE console. Continued use after changes means you accept them.

13. Dispute Resolution

These Terms are governed by Maryland law. Disputes will be resolved in Maryland courts, and you consent to personal jurisdiction there.

14. General Provisions

These Terms and our Privacy Policy constitute the entire agreement. If any provision is unenforceable, the rest continues in effect. Our failure to enforce any right doesn't waive that right.
